This Agreement (“Terms of Service” or “ToS”) governs your use of connectquest.co.in and Connect Quest Luit Horizon Labs, including all services, infrastructure, and offerings provided by Connect Quest, connectquest.co.in, or Connect Quest Luit Horizon Labs (“Company”, “we”, “us”). By accessing or purchasing services from connectquest.co.in or Connect Quest Luit Horizon Labs, you (“Customer”, “User”, “you”) agree to be bound by these legally enforceable terms and conditions.

1. Definitions

  • “Connect Quest”, “connectquest.co.in”, “Connect Quest Luit Horizon Labs” includes all affiliated legal owners, employees, infrastructure, and operations.
  • “Client” / “User” means any individual or legal entity purchasing or using any Connect Quest service.
  • “Service(s)” includes but is not limited to VPN hosting, VPS servers, web hosting, domain registration, software licensing, WHMCS integrations, cloud-based services, storage servers, email/SaaS services, and support tools.

2. Eligibility

By using our website or purchasing services, you confirm that you are at least the age of majority in your jurisdiction or have obtained legal consent to act on behalf of a minor.

3. General Conditions

  • We reserve the right to refuse service to anyone, at any time, for any reason.
  • Transmission of data (excluding payment card information) may occur unencrypted across various networks and be modified to conform to technical requirements.
  • We may change or discontinue services with or without notice and are not liable for such changes.

4. Optional Tools & Third-Party Content

  • Third-party tools and website links are provided “as is” without warranty.
  • Use of these tools is at your own risk.
  • We are not responsible for third-party content, policies, or practices and disclaim all liability for your use of external resources.

5. User Content Submissions

  • By submitting any content to connectquest.co.in or Connect Quest Luit Horizon Labs (e.g., feedback, reviews), you grant us an unrestricted, royalty-free, perpetual license to use, reproduce, adapt, and distribute such content.
  • We may edit or remove any submissions that violate our policies.

6. Data Accuracy and Account Information

  • You agree to provide complete and accurate information during registration and checkout.
  • Failure to do so may result in cancellation of orders or service suspension.
  • Fraudulent, abusive, or unlawful activity is grounds for denial of service.

7. Errors, Inaccuracies & Omissions

  • Occasionally there may be typographical errors or omissions related to service descriptions or availability.
  • We reserve the right to correct any errors or inaccuracies and to cancel orders involving incorrect information.

8. Personal Information & Privacy

  • Your submission of personal information is governed by our Privacy Policy.
  • We implement appropriate technical measures, including encryption and access control, to comply with Indian data protection regulations (CERT-In, IT Act).

8A. Legal Compliance, Log Retention & KYC

As per Indian law, including the Information Technology Act, 2000 and CERT-In 2022 guidelines:

  • KYC (Know Your Customer) is mandatory for all users before service activation. We require valid government-issued ID and address proof.
  • Access logs, metadata, session timestamps, source IPs, and usage footprints are retained for a minimum of 180 days, even after service cancellation.
  • These logs may be shared, without notice, with:
    • Indian law enforcement agencies
    • CERT-In
    • Cyber Crime Cells
    • Courts and other legally empowered entities

Violations are prosecutable under:

  • IT Act Sections 66A, 66C, 66D, 67, 67A, 67B
  • IPC Sections 292, 419, 420, 124A, 500, 505

connectquest.co.in or Connect Quest Luit Horizon Labs shall not be held liable for user actions that violate Indian law. Users accept full legal accountability for the use and misuse of assigned IP addresses, tunnels, emails, and content delivery systems.

9. Prohibited Activities

You may not use our website or services to:

  • Violate laws or regulations
  • Infringe on intellectual property
  • Harass or defame individuals
  • Spread malicious software
  • Send unauthorized marketing
  • Collect personal data without consent

Violation of these terms may result in immediate termination and reporting to the authorities.

10. Service Modification & Availability

  • We reserve the right to modify service offerings, pricing, or availability without notice.
  • All services are provided "as is" and "as available."
  • No guarantees of uptime or compatibility are implied outside specific SLAs in written agreements.

11. Termination

  • We may terminate your access to services without notice if you violate these terms or engage in illegal or abusive behavior.
  • Upon termination, outstanding fees become immediately due.

12. Indemnification

All users acknowledge and accept full legal liability for any abuse, criminal activity, misuse, or third-party harm originating from their account, virtual environment, domain, or assigned IP.

connectquest.co.in or Connect Quest Luit Horizon Labs acts solely as an infrastructure provider and shall not be held liable for:

  • Customer content or traffic
  • Misuse of infrastructure
  • Non-compliance by downstream users or resellers

The burden of proof and responsibility lies solely with the user, including during audits, regulatory inquiries, or criminal investigations.

In addition, you agree to indemnify and hold harmless Connect Quest or Connect Quest Luit Horizon Labs and its affiliates from any claims arising from your use of services, your breach of this agreement, or your violation of laws or third-party rights.

13. Service-Specific Compliance

VPN Hosting

  • You are deemed the legal operator of the VPN server provisioned to you.
  • All activity originating from your VPN is logged and may be disclosed to Indian authorities under lawful order.
  • Political misuse, illegal tunneling, censorship evasion, or routing masked activity is strictly prohibited.
  • Any attempt to obscure, encrypt, or anonymize logs through obfuscation tools may result in permanent suspension and legal referral.

VPS & Dedicated Servers

  • Users are solely responsible for all content, code, traffic, applications, databases, and operating system use.
  • The use of servers for port scanning, phishing, black hat SEO, IP spoofing, or email spoofing is prohibited.
  • PHP 8.1 and 8.2 are supported; all unsupported legacy PHP versions (including 5.x and 7.0–7.4) are blocked for security compliance.
  • Root abuse or privilege escalation attempts will result in immediate termination.

Storage / Mac Servers

  • You must not store or distribute child exploitation material, hate propaganda, malware, ransomware payloads, unlicensed software, or copyrighted content.
  • Storage nodes are monitored for abuse signatures, and encryption must not be used to hide illicit material.
  • Zero-tolerance policy applies to CSAM, illegal encryption vaults, and pirate libraries.

Domain Services

  • You agree not to register or configure domains for abuse-related activities (phishing, pharming, malware distribution, fake portals, copyright infringement).
  • WHOIS falsification or domain hijacking is a punishable offense.
  • Domains may be locked, suspended, or deleted in accordance with ICANN, INRegistry, or law enforcement requests.

Email & SMTP

  • All outbound mail headers, relay logs, and IP usage patterns are stored.
  • Bulk emailers must use dedicated IPs and provide opt-in proof.
  • The use of public SMTPs for unsolicited mail or mass relays is strictly banned.
  • Any customer contributing to global blacklisting will be suspended.

Licensing/Software Panels

  • License reselling or manipulation is strictly forbidden.
  • Key generators, nulled panels, warez panels, fake WHMCS or cracked scripts are permanently banned.
  • Misuse may result in reporting to software vendors and authorities.

Reseller Hosting

  • As a reseller, you accept full legal and financial liability for the actions of your clients.
  • Connect Quest does not offer downstream indemnity.
  • You must enforce these ToS upon your sub-users, and are expected to maintain verifiable logs, contact details, and usage metadata.

14. Service Level Agreement (SLA)

  • connectquest.co.in and Connect Quest Luit Horizon Labs maintains an internal target uptime of 99.9% for network and critical hosting infrastructure, excluding force majeure, user-originated software faults, DDoS attacks, or third-party disruptions.
  • Support is offered via ticket/email system for all verified customers. Higher-tier users (e.g., Managed VPS, Dedicated Servers, Corporate Clients) are entitled to priority queue escalation.
  • Scheduled maintenance windows (with at least 24-hour notice) are exempt from uptime calculations. Emergency maintenance due to system threats or zero-day exploits is not considered SLA violation.
  • Unless a premium SLA contract is explicitly signed, Connect Quest and connectquest.co.in and Connect Quest Luit Horizon Labs offers services on a best-effort basis only. No compensation, downtime credit, or SLA refund shall be entertained under standard plans.
  • For mission-critical deployments, clients are advised to subscribe to custom SLA plans which include performance guarantees, automated failover, and business continuity provisioning.

15. Refund Policy

  • Refunds are offered only within 4 hours of purchase where applicable.
  • Non-refundable items include: VPS, VPN, Dedicated Servers, Licenses, Voice Plans, Digital Software, or Gift Cards.
  • Refunds, if approved, are processed within 30 business days.

16. Binding Arbitration & Legal Waiver

  • All disputes shall be resolved via binding arbitration under the Arbitration and Conciliation Act, 1996 in Guwahati, Assam, India.
  • You waive all rights to approach courts, consumer forums, or commissions and agree arbitration is your sole legal remedy.
  • Class actions and consolidated proceedings are not permitted.

17. Governing Law & Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Jurisdiction lies exclusively with the courts of Guwahati, Assam.

18. Severability

  • If any provision of these Terms is found unenforceable, the remainder shall remain in full force and effect.

19. Entire Agreement

  • These Terms represent the complete understanding between the user and Connect Quest, connectquest.co.in, and Connect Quest Luit Horizon Labs, overriding any prior agreements.

20. Changes to Terms

  • We may revise these Terms at any time. Continued use of our services constitutes acceptance of those changes.

22. Final Declaration

By using our website or services, you confirm you have read, understood, and agreed to these Terms, accept full legal liability for misuse, and consent to binding arbitration in Guwahati, India.

This document supersedes all prior versions and merges all ToS, compliance policies, refund guidelines, privacy terms, and service-level commitments.
